SUBSCRIPTION TERMS AND CONDITIONS THIS AGREEMENT DESCRIBES YOUR RIGHTS AND RESPONSIBILITIES. PLEASE READ IT CAREFULLY.
1. Scope of Agreement: Under this Agreement ("Agreement"), www.employmenttalk.com and www.careercurve.com furnish on-line employment and career related services (the "Service") to registered subscribers or authorized users ("you", "your" or "subscriber"). By accessing the site, purchasing a subscription, product, or services, when registering, or if you use the Service, you agree to be bound by this Agreement. The term "use" means the use and availability of, access to, transmission to or from, or any exchange of information or communication in connection with or arising from the Service.
This entire agreement between you and the Service supersedes prior agreements regarding its subject matter. Whenever new products or services become available, your use of them will be under this Agreement unless Insala, LLC or Career Curve, LLC ("The Providing Company") notifies you otherwise. You must comply with any additional terms which apply to third-party content, software, the Service, or any other future services. The Providing Company may revise the terms of this Agreement at any time by updating this posting. You should visit this page periodically to review the Agreement, because it is binding on you. By continuing to use the Service, you agree to be bound by the changes in the new version of the Agreement. If any change is not acceptable, you may terminate your subscription as described below.
2. Scope of Service: All contents of the Service are provided for informational purposes only. You agree that the information you receive from the Service, from any person affiliated with the Service, or from any person not affiliated with the Service and encountered online or otherwise, should not be construed or interpreted as legal advice or is not to be construed or interpreted as an endorsement of any course of action or direction of any kind to be taken by you. Because user authentication on the Internet is difficult, the Service cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealing or control the behavior of participants on the Services, in the event that you have a dispute with one or more users, you release The Providing Company (and our agents and employees) from claims, demands, and damages (actual and consequential, direct and indirect) of every kind and nature, out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."
The Providing Company is under no legal obligation to, and generally does not, control the information provided by other users which is made available through the Service. By its very nature, other people's information may be offensive, harmful, or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that you will use caution and common sense when using this Service.
The Material may contain inaccuracies or typographical errors. The Providing Company makes no representation about the accuracy, reliability, completeness, or timeliness of the Service or the Material. The use of the Service and the Material is at your own risk. Changes are periodically made to the Service and may be made at any time.
You acknowledge and agree that you are solely responsible for the form, content, and accuracy of any resume or Material contained therein placed by you on the Service. Employers are solely responsible for their postings on the Service and on the Internet.
The Providing Company is not to be considered to be an employer with respect to your use of the Service and The Providing Company shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs found or posted on the Service.
The Service is not a registered financial or career advisor. The Service does not provide personal or commercial legal advice. The Service is a publicly available source that provides general career information. Remarks and data comprising the Service are for informational purposes only and are provided without warranty of any kind. In no event will The Providing Company (and our agents and employees), be liable for any direct, indirect, consequential, or incidental damages arising out of any decision made or action taken by you in reliance on the Service, whether or not caused in whole or part by our negligence.
THE PROVIDING COMPANY, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE ACCURACY, COMPLETENESS, CURRENTNESS OF THE MATERIAL, MERCHANTABILITY, RELIABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION, AVAILABLE THROUGH THE SERVICE, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.
THE INFORMATION PROVIDED ON THE SERVICE AND BY THE PROVIDING COMPANY IS ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE PROVIDING COMPANY DOES NOT WARRANT THAT THE SERVICE WILL OPERATE ERROR-FREE OR THAT THE SERVICE OR ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE SERVICE OR MATERIAL RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE PROVIDING COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS OR ASSOCIATED COSTS.
3. Subscription Information and Cancellation: You will provide The Providing Company with accurate and complete registration information required for the subscription Service. You will advise The Providing Company promptly of any changes to your information. If you do not, you will be in breach of this Agreement allowing The Providing Company to immediately terminate your subscription and use of the Service. The Providing Company reserves the right, at its sole discretion, to pursue all of its legal remedies including, but not limited to, deletion of your complete information from the Service and immediately terminate your subscription with or ability to access the Service and/or any other service provided to you by The Providing Company, upon any breach by you of this agreement or if The Providing Company is unable to verify or authenticate any information you submit to the Service. When you subscribe or gain access to the Service, you will receive a user name and password. The Service may assign it to you or it may be selected by you. You may not select a user name that violates anyone's rights or one, in our sole discretion, we consider offensive, improper or inappropriate. If you do, the Service can modify or delete it.
Please note that due to processing costs the fees for monthly, quarterly, and/or annual memberships are non-refundable.
In order to CANCEL YOUR SUBSCRIPTION, visit Support within your account, select "Cancel Subscription" as an option, and let us know that you wish to cancel your subscription. You will receive a response for cancellation within 24 hours.
If you FORGET YOUR PASSWORD, please use the password reminder on your login page and an automatic reminder will be sent to your email account.

You may not post any content from the Service to news groups, mailing lists, or electronic bulletin boards without our prior written consent. Copying and/or electronic transmission of any content of the Service is a violation of U.S. and international copyright law. All information sent to www.employmenttalk.com and www.careercurve.com becomes Company property. All information can be used at The Providing Company's discretion.
The contents of the Service, such as text, graphics, images, logos, button icons, software, and other "Material" are protected under United States and foreign copyright, trademark, and other laws. All Material is the property of The Providing Company or its content suppliers or clients. The compilation (meaning the collection, arrangement, and assembly) of all content on the Service is the exclusive property of The Providing Company and protected by U.S. and international copyright laws. The Service authorizes you to view and download a single copy of the material on the Service solely for your personal, noncommercial use.
Unauthorized use of the Material may violate copyright, trademark, and other laws. You must retain all copyright, trademarks, service mark, and other proprietary notices contained in the original Material on any copy you make of the Material. You may not sell or modify the Material or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose. The use of the Material on any other web site or in a networked computer environment for any purpose is prohibited.
You shall not copy or adapt the HTML code that The Providing Company creates to generate its pages. It is also protected by The Providing Company's copyright.
You also agree that you will not give out logins and or passwords to other users. We reserve the right to cancel any subscription, without refund, if we discover that more than one person is using a subscription account or if a login and password is given to another person. Our database will notify us immediately of such infractions and your privileges will be denied.
You agree not to resell or assign your rights or obligations under this Agreement. This Agreement is personal to you only and non-transferable.
You also agree not to make any unauthorized commercial use of the Service including but not limited to the following: 1.) Posting any incomplete, false, or inaccurate biographical information or information which is not your own accurate resume (living individual seeking employment on a full-time or part-time basis on his or her own behalf); 2.) Posting any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement, or other business opportunity which requires an up-front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors, or sub-agents; 3.) Deleting or revising any material posted by any other person or entity; 4.) Using any device, software or routine to interfere, or attempt to interfere, with the proper working of the Service or any activity being conducted on the Service; 5.) Taking any action which imposes an unreasonable or disproportionately large load on the Service's infrastructure; 6.) Disclosing or using passwords with any third parties or using your password for any unauthorized purpose; 7.) Notwithstanding anything to the contrary herein, using or attempting to use any engine, software, tool, agent, or other device or mechanism (including without limitations browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the Service other than the search engine and search agents available from The Providing Company on the Service and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Explorer); 8.) Attempting to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service.
5. Limitation of liability: The aggregate liability for The Providing Company to you for all claims arising from the use of the Materials is limited to US $100.
6. Failure to Access Service: You agree that we are not responsible for your inability to log-on to the Service either because of poor Internet connections, incorrect typing of log-ins or passwords, and/or browser incompatibility. We will make every effort to ensure that our servers remain operational with adequate performance and response time. However, there may be times when our servers are down or response time is slow due to power outages, network problems, regular maintenance, or high traffic volumes. You agree that The Providing Company is not responsible or liable for any loss or damage (actual and consequential, direct and indirect) caused by your inability to use or access the Service, whether or not caused in whole or part by our negligence.
7. Indemnification; Governing Law; Jurisdiction: You agree to defend, indemnify, and hold The Providing Company (and our agents and employees) harmless from and against all liabilities, damages, (actual and consequential, direct and indirect) claims, actions, costs, and expenses (including attorneys fees), in connection with or arising from your breach of this Agreement or use of the Service.
The Providing Company makes no claims that the Materials may be lawfully viewed or downloaded outside of the United States. Access to the Materials may not be legal by certain persons or in certain countries. If you access the Web Site from outside of the United States, you do so at your own risk and are responsible for compliance with laws of your jurisdictions.
This Agreement is personal to you, and you may not assign your rights or obligations to anyone. If any provision of this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. This Agreement shall be deemed to have been made in the State of Texas, and shall be governed by the laws of the State of Texas, exclusive of its rules governing choice of law and conflict of laws. The parties expressly stipulate to jurisdiction in Tarrant County, Texas, or the United States District Court, North Texas District of Texas, as appropriate.
